López Obrador challenges the suspension of the reform to the Hydrocarbons Law

The president and the Ministry of Energy (Sener) have challenged the suspension of the reform of the Hydrocarbons Law, which seeks to strengthen the presence of the state-owned Pemex in the market and which is currently suspended due to the order of two judges specialized in competition.

The executive and the Sener have filed a series of complaint appeals before the First Collegiate Court in Administrative Matters specialized in Economic Competition to reverse the measure that has stopped the implementation of the reform, according to a list of the Council of the Federal Judiciary.

The complaint remedies are intended to reverse the decision made by Juan Pablo Gómez Fierro and Rodrigo de la Peza, the two judges specialized in competition who have ordered the suspension of the reform after companies in the sector have submitted applications for protection.

This appeal is presented in the usual way in amparo proceedings, as part of the defense undertaken by one of the parties involved.

If the court decides to rule in favor of the Sener and the executive, the suspension could be removed, although this will not have a substantive impact on the final resolution of the amparo.

The reform to the Hydrocarbons Law was suspended last May, just one day after its publication in the Official Gazette of the Federation. and put order in a series of permits to private companies that do not operate regularly or that have not been used.

The initiative to reform the Hydrocarbons Law mainly modifies the dynamics in the issuance and cancellation of permits in the oil market, in this last point it adheres that an authorization can be suspended if it goes against national security, energy security or the economy. national.

It also opens the door for facilities related to suspended permits to be used by state-owned Pemex.

The hydrocarbon market had remained unchanged in recent months, unlike the electricity sector, which has undergone constant changes since the beginning of the federal administration.

But in the last two months, two reforms have been approved, one of which removes a series of more rigid rules from Pemex, which have modified the perception of sector participants. So far the judges have ruled in favor of private companies and both reforms are suspended.
