Profeco wins class action lawsuit against Interjet

The Federal Consumer Attorney’s Office (Profeco) announced that it won before a federal judge the class action lawsuit filed against Interjet after the complaints received during the years 2018 to 2020.

Among the reasons for disgust there were flight cancellations, missed flights, connections, delays, among others, according to the institution. With the resolution in favor of Profeco, 7,317 consumers represented by the body through the Legal Sub-Attorney will benefit.

“After exhausting all the procedural stages, on October 3, 2022, a final judgment was issued condemning the airline to pay damages to the consumers affected by the breach of the passenger air transport service provision contract. , plus 20% as a discount on the cost of the ticket, as well as 9% of the legal interest on the amounts generated”, pointed out Profeco.

The agency detailed that the amount claimed with the bonus amounts to 144 million 020,781.33 pesos.

Others against Interjet were unilateral undue charges, change of itinerary without prior notice and refusal to provide the service.

In addition, the judicial resolution, declared final on October 18, establishes that those affected who have not adhered to the trial in the second stage in execution of the judgment of the Collective Action, can do so, presenting evidence of the damage suffered, in the term from October 24, 2022 to October 24, 2023.
