The case is based on a situation from 2017. At that time, a speaker from the Amadeu Antonio Foundation called the former DSDS juror an anti-Semite in a lecture. Xavier Naidoo then sued the person in 2017. At first the singer got right. The Federal Constitutional Court decided differently and agreed that the interpreter of “This Way” could be described as an anti-Semite in the lecture.

The OLG Nuremberg had previously prohibited the designation. At that time, the reason for the injunction judgment was that the speaker had not been able to sufficiently substantiate her allegation.
