Two mothers from Baden-Württemberg did not want their children to be tested in school – and complained against the obligation to test. The administrative court in Mannheim has rejected the urgent requests.
Mannheim – As long as students are taking part in face-to-face classes, they have to be tested. The administrative court in Mannheim has now once again confirmed the compulsory corona test for students in hotspot regions * (BW24 reported). On Tuesday, the urgent requests from two mothers against what they saw as illegal regulation were rejected. The Mannheim judges are convinced that regular tests at schools can prevent the virus from entering schools, and prevent infected people from being identified and quickly isolated. Infection chains could be broken better this way – even if it is only a snapshot.
In view of the slightly falling incidence of the coronavirus in Baden-Württemberg *, alternating classes could soon be possible again in the southwest. The condition for this is an incidence below 165 on five consecutive days. This could be the case in almost half of all urban and rural districts in Baden-Württemberg in the next few days if the numbers continue to fall. However, face-to-face teaching is not compulsory. Parents can free their children from it.
Compulsory test in school: The mothers’ reasons were declared unfounded by the court
Pupils who take part in classes at the school must always present a negative test. However, the mothers who made the urgent requests argued that the handling of the tests was dangerous for the children. The court rejected this objection on the grounds that the parents could carry out the tests themselves, as could pharmacies, medical practices or municipal test centers. The encroachment on the fundamental rights of students through the compulsory test as a prerequisite for school attendance is proportionate in view of the risk in the pandemic.
One of the two mothers, a high school teacher with an elementary school child, had also claimed that she was not trained to monitor the tests. She is afraid of consequential damage and liability issues. The First Senate made it clear that it is not obliged to do so by the contested regulation.
Parents had also protested against the requirement to wear a mask at school
The obligation to test is not the only regulation in connection with the corona pandemic that has been criticized. Thousands of parents are also resisting the mask requirement for children *. More than 500 parents from the Calw district had networked in a WhatsApp group. There they called for a protest against the mask requirement for elementary school students in Baden-Württemberg. Most recently, parents in Esslingen had protested against the mask requirement at schools *. * BW24 is an offer from IPPEN.MEDIA
