Argentina passes a law that provides job quotas for transgender people

BUENOS AIRES, Argentina- The Argentine Chamber of Senators approved a law on Thursday that promotes formal employment for transvestites, transsexuals and transgender people in the national public sector and provides tax incentives for the private sector to also comply with the regulations.

The norm establishes a work quota of at least 1% of the total positions in the three branches of the national State, in Public Ministries, decentralized or autarkic bodies, non-state public entities, companies and government companies in all their contracting modalities .

Meanwhile, it stipulates that educational completion cannot be an obstacle to entry and permanence in the position.

It also provides for tax incentives for private companies for one year, a term that is extended to two years in the case of small and medium-sized companies that hire the beneficiaries of the law.

And he adds that the Banco de la Nación Argentina, from the public sphere, must promote credit lines with preferential rates for the financing of productive, commercial or service undertakings, individual or associative, specifically aimed at transvestite, transsexual and transgender applicants.

The Senate sanctioned the law – which bears the name “Diana Sacayán Lohana Berkins”, in honor of two activists who fought for the visibility of trans people – with 55 affirmative votes, one negative vote and six abstentions, after deputies approved it. two weeks ago with 207 affirmative votes, 11 negative and 7 abstentions.

“It is a historic day,” said the Minister of Women, Gender and Diversity, Elizabeth Gómez Alcorta, in a statement.

The minister recalled that “guaranteeing the rights of transvestites and trans people is a priority of the national government,” which is why since September 2020, the Alberto Fernández administration had implemented this policy by decree in the National Public Administration.
