The digital canon with which the purchase of digital reproduction media such as CDs, DVDs and MP3s, as well as hard drives was taxed, has just been annulled.
The National Court (AN) today issued a resolution that annuls the digital canon, in addition to the ruling of the European Court that declares its collection from companies and administrations illegal. The Association of Internet Users, which filed an appeal against the regulation that regulates the digital canon in 2008, has celebrated the resolution that annuls this “compensatory measure”, as defined by the management entities.
The Contentious-Administrative Chamber of the National High Court has stated that it understands that the ministerial order that regulates the digital canon is a regulation and, therefore, its approval would require certain procedures related to justifying and financial reports, and an opinion of the Council of State , which were not done. Therefore, the National Court considers that this norm is affected by a radical vice. The claim that the proceeds of the canon be returned due to lack of competence has also been rejected.
