Tortilla manufacturers are targeted by COFECE for alleged price manipulation

The Federal Economic Competition Commission (Cofece or Commission) reported in a statement that it summoned various economic agents (companies) upon finding evidence of a probable "absolute monopolistic practice" in the market for the production, distribution and marketing of corn tortillas in the municipality of Huixtla, Chiapas.

"At the conclusion of the investigation, the Cofece investigating authority ruled the possible existence of an agreement to manipulate the prices and supply of corn tortillas by establishing the obligation not to produce, process, distribute or market a restricted quantity of it" reported the body.

Cofece pointed out that this investigation (file DE-032-2019) is relevant because this type of illegal practice, also known as collusion, can have adverse effects on the well-being of consumers, since the tortilla is an important product in the diet. of the Mexicans.

From this moment, those who are pointed out for their probable responsibility in monopolistic conduct may express what is appropriate to their right and offer evidence for their defense.

Once these statements have been made, the evidence has been presented and the corresponding arguments have been presented, the Cofece Plenary will resolve in accordance with the law.

If it is proven that illegal conduct was carried out, the economic agents could be sanctioned with fines in accordance with the Federal Economic Competition Law. They could also face criminal proceedings with penalties ranging from five to 10 years in prison.
