The ASF indicates that Pemex omitted fines for 159 million pesos to the contractor of two pipelines

Pemex Exploración y Producción did not apply fines of 159.5 million pesos (mdp) to the contractor responsible for the construction of two marine pipelines, the firm J. Ray Mcdermott de México, for the Ku-Maloob-Zaap Integral Project, the most productive of the oil company.

The works were delayed by 314 days on one of the lines and 339 on the other, but the Pemex subsidiary did not apply the conventional penalties for this delay on the dates stipulated in the contract.

In addition to the 159.5 million pesos pending clarification, the Audit notes that the amount of the economic proposals of the participants in the tender was not indicated, “because the tender procedure was not carried out in accordance with the provisions of the bases” .

The executive project also presented deficiencies and did not clarify why it included 10,600 tons of stone material, a requirement that was later removed from the bidding rules. Among other problems pointed out by the Audit, the work was carried out with a vessel other than the one specified, without the authorization of the change, the videos of the survey of the trajectory of the pipelines were not delivered and it was paid outside the norm in a concept which included a project book, without it being delivered.

The ASF report indicates that Pemex provided documentation to try to show that the application of the fines was not omitted, but these did not correspond to the total amount. “Once the information and documentation provided by the audited entity has been analyzed and evaluated, the Superior Audit of the Federation considers that the observation subsists, (…) because the contractor did not complete the work on the established critical dates, did not submit the information and documentation proving that the incidents and events that affected the execution of the works were caused by force majeure events, and the as-built plans were not delivered in all of its specialties within the established deadlines. “
