What is the IMSS orphan's pension and who can receive it?

The children of workers insured by the IMSS may be beneficiaries of an orphan’s pension in the event of the death of their parents. Find out what it consists of, who can be beneficiaries, the age limit to receive the pension and the requirements to process it.

What is the orphan’s pension?

When an insured of the Mexican Institute of Social Security dies, their children can receive the orphan’s pension. This is granted to children under 16 years of age or up to 25 if they are studying.

Amount of the IMSS orphan’s pension

If each child is orphaned of a father or mother, 20% of the pension that the deceased had or that which would have corresponded to the worker who died is given. If he is an orphan of both parents, he is granted 50%. At the end of the enjoyment of the pension, the orphan will be given a settlement equivalent to three monthly payments of his pension.

Requirements to process the orphan’s pension

This is a procedure that must be carried out in person at the Family Medicine Unit or at the Assignment Subdelegation from 08:00 to 15:00, or during extended hours determined by the mayor’s office. To do this, the possible beneficiary of the orphan’s pension must meet the following requirements:

  • Prove the affiliate relationship with the deceased insured or pensioner.
  • Confirm the age of the child.
  • That the insured would have had at the time of his death, 150 weeks of contributions and be in force or in conservation of rights (Invalidity, Retirement, Unemployment in Old Age or Old Age).
  • In the case of the death of the insured, derived from a work risk, the Report of Permanent Disability or Death due to Work Risks ST-3 is required, issued by the Institutional Medical Services, which will be provided by them.
  • If the deceased insured enjoyed a permanent disability pension and dies for a reason other than a work hazard, it will be necessary to prove a minimum of 150 weeks of contributions and that he/she had caused withdrawal from the Compulsory Scheme. The aforementioned contribution period will not be required if the total permanent disability pension received by the deceased insured did not last more than five years.
