The Second Chamber of the Supreme Court of Justice of the Nation granted an injunction to TV Azteca to review again if it must pay more than 2,447 million pesos of Income Tax (ISR) that it owes to the SAT for the fiscal year of 2009 .
“The justice of the union protects and protects the complaining party (TV Azteca) against the resolution claimed,” the document details.
This is an old lawsuit. On April 1, 2016, the SAT issued the determining resolution, in which it established a tax credit in charge of TV Azteca for more than 2,000 million pesos for omitted contributions of the updated Income Tax (ISR), surcharges and fine regarding of fiscal year 2009. In May 2017, Ricardo Salinas Pliego’s company filed an appeal for revocation against the resolution, seven months after the issuance of the amparo, it was decided that the appealed resolution was confirmed.
But the issue became relevant again in April 2021, when President Andrés Manuel López Obrador called on companies to pay their taxes requested by the SAT, or else “it will proceed by legal means.” However, Salinas Pliego assured that he will not pay the payment attributed to him by the SAT, since he has initiated an amparo appeal.
In the fourth quarter of 2021, TV Azteca explained that the omicron variant, the blows of inflation in the Mexican economy and the decrease in advertising affected its financial results. The company’s net profit fell 81.3%, reporting 251 million pesos, compared to 1,344 million pesos in the same period of the previous year.
As of December, TV Azteca’s debt was 12,629 million pesos, compared to 13,529 million the previous year, whose decrease is due to the reduction in the balance of the company’s Stock Certificates carried out last March.
