No amicable settlement in the discrimination process

Are women allowed to participate in traditional fishing in the Allgäu? The organizing association says: No. A female member had sued against this – and won.

Memmingen – In the court dispute over discrimination against women at the traditional Fisherman’s Day in Memmingen, Bavaria, those involved rejected an amicable settlement on Wednesday.

The Fischertagsverein had emphasized that the result of a conciliatory procedure had to be approved by the assembly of delegates. Thereupon the lawyer said to the plaintiff that a negotiation to goodness made no sense in this case due to the lack of legal certainty. The regional court in the city on the border with Baden-Württemberg had suggested, among other things, that the association could set up a sub-group for women fishermen.

The presiding judge Konrad Beß had previously campaigned for an amicable settlement. The risk of losing in this dispute is great for both parties. The loser would probably also face high legal costs – especially if the proceedings go to the Federal Constitutional Court or the European Court of Human Rights, said Beß. A revision by the Federal Court of Justice would be permitted in any case in the event of a judgment.

A plaintiff had won in the first instance before the local court against the organizers of the annual traditional fishing. The fact that only men are allowed to actively participate in the climax of the fishing day is discrimination. The Fischertagsverein appealed against the judgment. Every summer at the event, the participants jump into the Memminger Stadtbach and get trout out of the water. Whoever catches the biggest fish becomes the fishing king. dpa
