Interjet protects itself against a ruling that asks it to pay 1,800 million pesos to workers

The Interjet union reported an injunction promoted by the airline against asking it to pay around 1,800 million pesos in wages and benefits to its more than 5,000 workers, which it owes since September 2020 and which led to a strike that continues till the date.

In a statement sent to its members, Section 15 stated that the appeal filed by the company will be resolved in August by the Sixth Collegiate Labor Court of the First Circuit, once the courts of the Judicial Power of the Federation return to their jurisdiction. holiday period.

“We are convinced that the decision of the Collegiate Court should be in the sense of agreeing with the workers and, therefore, denying the protection promoted by the company,” said Francisco Joaquín del Olmo, director of Section 15, in the statement of which Expansión has a copy.

On April 22, the Interjet union reported that a 15-day period had been met that the JFCA gave the company to resume its work -suspended since December 2020- and make a payment of 1,893 million pesos in wages and benefits.

The company’s failure to comply gave rise to Section 15 seizing its assets and starting the process to auction them, with the aim of reimbursing the debts that remain with the airline.

“For this reason, we started (…) the process of executing the award to seize and auction off the assets owned by the company to the extent possible,” said the director of Section 15 in a statement at the time.

The union also made reference to the entry of Interjet executives to the airline’s headquarters, located in Mexico City, where Carlos del Valle , deputy director of the company, claimed to be “working” since July 1. However, it is an income that will only be allowed for a period of 30 days as part of the process to formally start the commercial bankruptcy promoted by the airline from the beginning of 2021.

“Following the legal process of commercial bankruptcy to which the company is subject, the Second District Judge for Commercial Bankruptcy, ordered the Federal Conciliation and Arbitration Board, and the latter the union, to grant access to the Interjet facilities to the visitor and representatives of the company, so that the latter deliver the documentation that proves that Interjet is within the assumptions that the law establishes to enter commercial bankruptcy”, the document explains.

In recent days, sources confirmed to Expansión that a resolution was expected by the end of the month that would allow the auction of the airline’s assets to begin. Despite the presentation of the protection, the union seems to continue with this plan.

“On the part of the workers, nothing would give us greater pleasure than Interjet being successful in its restructuring. However, more than 20 months after seeing the last Interjet plane take off, the path of commercial bankruptcy that the company is seeking has not even formally begun and the workers cannot wait,” said Del Olmo.
