What documents are necessary to get married?

The coronavirus brought to a halt one of the most celebrated events in Spain during the spring and summer season: weddings. People stopped marrying out of fear of a spread of the virus, in addition to the restrictions imposed that limited large celebrations. But now in 2021 it seems that couples are more determined and weddings are taking place between security measures and limitations. Have you thought about getting married? Do you know what documents you must provide for the wedding?

Documents for a civil wedding

According to a 2016 study carried out by the Family Policy Institute, two out of three married couples decide to marry civilly, (63%) . When we are going to prepare a wedding, many couples do not know all the necessary documents that must be presented to make it official. The first thing we must do is make an appointment at the town hall so that they can summon us one day to celebrate the wedding ceremony.

In a civil wedding these documents are necessary:

  • Original and photocopy of the DNI
  • Certificate of registration
  • Birth certificate
  • Instance of the Civil Registry
  • Affidavit of marital status of the single person. This paper is usually requested directly at the Civil Registry
  • Previous marriage certificate and the deceased spouse’s certificate if required.

In addition, the processing of the file involves having some witnesses who will serve to attest that this link is valid. This document to process the file is presented before the wedding in the Civil Registry, thus it will be certified that none of the members of the couple are marrying against their will.

On the other hand, two other witnesses will be in charge of signing the marriage certificate. They will attend the reading of the minutes and sign it showing their agreement with the link.

The fastest way to get married is to do it before a notary, since it will take care of all the paperwork and we will only have to present the DNI and go with two witnesses. The notary will take care of the paperwork and it will cost us between 100 and 160 euros.

Church wedding

On the other hand, the other great way to get married is through the church, a method traditionally used by couples. This is done to obtain the canon certificate of the church, which will also present these documents in the Civil Registry for the wedding to be effective.

These are the necessary documents:

  • The birth certificate of both parties.
  • The parents’ family book.
  • The photocopy of the DNI, passport or residence card of both.
  • A certificate of ecclesiastical singleness if the couple are from a diocese other than the one chosen for the wedding.
  • A death certificate if someone is a widower, of his deceased husband or wife.
  • A parental permission if either of the two future spouses is a minor.
  • Some dispensations in the event of a case noted by Canon Law (marriages between baptized and unbaptized, different nationality, different religions …).
  • A certificate of premarital courses. These can be attended in the same parish of the wedding or in another.
  • One adult witness for each groom. As documentation they will need your ID. The church will ask you some questions that you will need to answer.
  • Several witnesses on the wedding day. They may be different from the previous ones.
  • If anyone is divorced, their civil and canonical freedom to marry must be established before being admitted to a canonical wedding. Marriage certificate with marginal notation of divorce will be required.
