Schweinfurt – Because she did not care for her newborn after the birth and let it die, a mother was sentenced to eight years and three months in prison.
The 27-year-old had concealed her pregnancy and acted with “great recklessness”, said the presiding judge on Thursday in front of the Schweinfurt regional court.
A personality disorder was found, but did not affect the defendant to any significant extent. The verdict is not yet legally binding.
The father found the lifeless body of his child shortly after the secret birth in August 2020 in the bathroom of the apartment in Schweinfurt. Before that, his mother had locked herself in the bathroom and reassured him to leave her alone in the bathroom and go to sleep.
A medical examiner assumes that the child must have been alive based on muscle tension found during the autopsy of the infant. It either suffocated, died of hypothermia, or a combination of both.
The 27-year-old not only killed her own child, but also that of her partner, who knew nothing about the pregnancy, said the chief prosecutor. “He still stands by her even now, even though she killed his child.” The woman had initially been accused of murder, which the public prosecutor revised due to the lack of murder features in the pleading.
The court also did not recognize any base motives for the act, which is why the verdict is manslaughter. However, the sentence is higher than the seven and a half years required by the public prosecutor’s office. The defense advocated manslaughter by omission and a penalty that allowed for parole.
According to the court, the German had no fear that the partner would have rejected the child. According to the Chamber, the occupational therapist, who had already given birth to a son during her school days, was not prepared to accept economic and personal restrictions from having another child.
According to her own statement, she feared, among other things, that she would lose her temporary job. In addition, due to traumatic experiences during the first delivery, which was accompanied by high blood loss, she was apparently afraid of a new birth. According to her own statements, this was one of the reasons why she had suppressed the pregnancy.
The board saw a repression as not proven, since she had, among other things, described her concerns about a possible pregnancy to friends, as emerged from WhatsApp chats.
