His friend from Hamburg is underage and pregnant. She cannot be persuaded to have an abortion. The 26-year-old resorted to a brutal means that is now supposed to bring him to prison for several years.
Hamburg (dpa) – The first time after a kiss, the second time after a cell phone light signal from her boyfriend, there are suddenly hits and kicks on a 17-year-old in a Hamburg park at night.
The 26-year-old staged the raids according to the conviction of the St. Georg District Court in order to end his girlfriend’s pregnancy, which he did not want. The lay judge sentenced him on Wednesday for dangerous bodily harm and attempted abortion to three years and three months in prison. The judges acquitted a co-defendant for lack of evidence (Az. 948 Ls 28/21). Both suspects are 26 years old and come from Syria.
When the young woman found out about her pregnancy in October 2019, she enthusiastically showed her boyfriend ultrasound images. But the 26-year-old, with whom she has been together for two years, does not share the anticipation, as judge Matthias Lux explains in the verdict. The Syrian explains that his father does not agree with the pregnancy. With tears he asked her to have an abortion. She first agrees and receives gifts from him. Then the 17-year-old reveals that she wants to keep the child.
On October 27, the two of them walk back from their parents in the Billstedt district to his apartment through a dark park. He pulls you further and further into the green area. Finally he demands a kiss from her. Immediately afterwards a stranger pushes her and hits her in the face with a fist. When she is on the ground, the attacker pulls up her legs and kicks her in the stomach over and over again. Her friend pulls the stranger back and follows the fugitive for a few meters. His girlfriend sees how he reaches him, holds him tight – and lets go again. At the hospital, doctors find that the nine-week-old pregnancy is intact.
Five and a half months later, the second attack occurs. On the evening of April 13, 2020, the 17-year-old asks her boyfriend to accompany her to a cell phone seller. According to the judge, the 26-year-old initially has no desire, but then agrees. Again he leads the now eight months pregnant into a park while he is constantly talking on the phone in Arabic, which is incomprehensible to her. In a dark place he holds up his cell phone with the illuminated display. Again she suddenly gets a punch in the face, then more punches and kicks. In agony, she clings to her boyfriend, and they both fall to the ground. The 26-year-old pulled a jacket over her head, apparently for protection. But she still sees that he is beating her too. Believing to have burst the amniotic sac, the stranger flees, as Lux continues.
The 17-year-old also runs and can speak to a passerby on the street who calls the police. In the hospital, contractions start, the doctors do an emergency caesarean. According to the judge, the accused inflicted some cuts himself – and reported to the police as an alleged victim. “The plan of the crime was always marked by cunning,” says the judge. Both acts would have been directed against their own partner and their own child. “First of all, you have to bring about beating a heavily pregnant woman,” remarks Lux. Fortunately, neither the child nor the mother would have retained any permanent physical damage.
According to the indictment, the co-defendant should be involved in the second offense. The court saw evidence of this, but insufficient evidence. The two men spoke on the phone and chatted with each other again and again on the evening of the crime. But the woman described the attacker’s stature differently. No DNA traces of the accused were found on her clothing.
The prosecution had demanded one and a half years probation for the co-defendant and three and a half years in prison for the main defendant. The verdict is not yet legally binding.
