Compensation with 4.2 million euros to a girl who suffered cerebral palsy due to negligence in childbirth

Delayed cesarean section and other medical errors

As explained in the sentence, the mother entered, after breaking water, in a public hospital in Seville around 12:50 on February 5, 2015. At that time, they detected the presence of meconium (the baby’s first poop), which It forces to advance the delivery due to the possible risk to the fetus.

However, the cesarean section was not performed until almost four hours later and ended at 5:10 p.m. The baby had a lack of oxygen (hypoxia), which caused serious consequences: cerebral palsy, blindness, severe tetraparesis and psychomotor retardation.

According to the judges, 80 percent of the girl’s recognized disability was caused by the lack of control of the delivery, the absence of taking the pH of the fetal scalp (a test that is carried out during active labor to check if the baby you are getting enough oxygen) and because:

“Cesarean section was belatedly indicated and practiced, producing acute fetal distress with hypoxia-ischemia, the one born after 30 minutes of life presenting whining and nasal flaring, characteristic of this lack of oxygenation. There was a causal relationship between intrapartum hypoxia and injuries neurological “.

The SAS will have to pay the family 1.5 million euros and the insurance company, Zurich, 2.7 million euros. The ruling is actionable within 20 days.

The parents have not wanted to make public their identity or the name of the hospital, but they have wanted to share their story so that another family does not have to go through the same thing.
