Starnberg Murder Trial: New Suspicion

Two weeks after the start of the trial of the murder of a family in Starnberg, the defense of a defendant made violent allegations against the police.

Starnberg / Munich – The first look at the crime scene was probably the wrong one – but how right was the second? The sensational trial of the murder of a family in Starnberg raises more and more questions.

Is the prosecution’s assumption correct that a young man stole from his friend and therefore shot him and his parents in cold blood? How reliable is the confession he made to the police? And what role does another friend of the murdered son play, in whom ammunition was found from the murder weapon? The Regional Court of Munich II will have to deal with these questions when the hearing continues this Monday (9.15 a.m.).

An investigator is invited as a witness, with whom the main accused 21-year-old, according to the police, made a confession and incriminated his friend and roommate, a 20-year-old Slovak, as an accomplice. The defense of the alleged accomplice now wants to prevent this investigator from testifying. Because she raises serious allegations against the police. It’s about nothing less than torture.

Witness should not be heard

The Slovak’s lawyer, Alexander Stevens, and his team want to file a motion on Monday not to hear the summoned witness and not to admit the confession made to her as evidence. It is the only time that the main defendant has commented on the allegations, so far he has remained silent in the process.

In a letter to the Regional Court of Munich II it says: “The information allegedly obtained is based on prohibited methods of interrogation”. The lawyers accuse the police of “humiliation, torture and mistreatment” during the interrogation in Fürstenfeldbruck. The police firmly reject this: “The accusation of torture has no basis whatsoever,” said a spokesman for the Upper Bavaria North Police Headquarters on Sunday.

“The cell was dark, apart from a neon lamp,” the lawyers continue to write. The accused, who incriminated her co-accused client in his testimony, was “either completely naked or only dressed in underpants and, moreover, only poorly provided with a brown blanket”. Due to severe neurodermatitis, the young man had “bloody spots all over his body”.

No records

According to Stevens, the questioning of the German was not recorded. Thereby “the torture (…) should obviously be concealed”. The questioning was said to have taken place “in the detention cell, without any logging or prescribed recording”. The investigator appeared there “only with a buttered pretzel”.

The police do not want to comment on the allegations. “Respect for the judiciary requires that the police refuse to provide any information in an ongoing legal proceeding about incidents that are being dealt with in this proceeding. If the defense brings such allegations in court, they will be the subject of judicial review, ”said the spokesman.

The prosecutor is convinced that the now 21-year-old main defendant wiped out the family on the night of January 2020 – a 60-year-old woman, her 64-year-old husband and their son. He then stole the son’s valuable collection of weapons. Among other things, he is on trial for murder.

Initially, the investigators assumed a different scenario. Namely about the fact that the son shot his parents first and then himself. He was found with the gun in hand and traces of smoke were found.

Doubts remain

The defense of the co-defendant also has serious doubts about the new version of the public prosecutor’s office and states that there are numerous hypotheses about what happened in Starnberg that January night 2020.

She is therefore also paying great attention to a second witness who was on the agenda for this Monday: ammunition from the murder weapon was found in the other friend of the murdered son, as confirmed by the Munich II public prosecutor. “After evaluating all the findings available so far, the public prosecutor’s office is not assuming a third suspect,” emphasized a spokeswoman. The 20-year-old’s defense has doubts about this assessment. dpa
