On January 16, 2013, a pregnant woman went to the Virgen de la Victoria University Hospital in Malaga with childbirth symptoms. After she was admitted, she was transferred to the delivery room where she was treated by the gynecologist and a midwife.
During delivery, the newborn fell to the ground from a great height suffering head trauma and bruises. The parents decided to report it and the Andalusian Health Service (SAS) has estimated the claim and decided to compensate the family with 46,942 euros.
As reported by the Association ‘El Defender del Paciente’, which has represented the girl’s parents, the injuries have caused her to be delayed in maturation and school, the need for special care , as well as recognition of disability, not ruling out possible future neurological damage.
“Lack of care by health personnel”
This has been recognized by the SAS when partially estimating the claim, which it considered “surprising and inadmissible to let a baby fall to the ground at the time of birth in the hospital, hitting the head strongly, due to a lack of care by the health personnel who attended to the woman in labor ”.
The association explains the facts as follows: while the midwife was putting pressure on the belly, the gynecologist introduced forceps to help the baby to be born and when half of her body was already out, “she turned around, ignoring the situation, so the newborn fell from a great height ”.
They add in the claim that the newborn “hit her head with surgical metal, causing the umbilical cord to tear and break .” Therefore, they consider that:
“There was a lack of coordination in the health personnel who attended the birth, which caused the baby to fall to the ground, an issue that cannot be allowed in this type of situation.”
He suffered a hemorrhage and serious consequences
It is explained that the baby was immediately transferred to the Maternal and Child Hospital where she was diagnosed with “hemorrhage with possible cerebral edema.”
In the following days, “small bilateral occipital subdural hemorrhagic foci and an occipital parietal parenchymal contusive foci” were found, which implied that the little girl was admitted for 16 days.
The mother filed a claim at the hospital and asked for an investigation into what happened. He received a letter of apology from the center.
And now the SAS estimates that there is a causality between the performance of the center and the injuries of the little girl, since as established in the birth protocol and that the mother’s lawyer added in the allegations, “the baby must be restrained at the time of delivery. birth, an issue that was not carried out in this case by dropping the girl directly to the ground ”.
Even so, the Association of the Patient Defender has explained that the parents do not rule out claiming a higher amount before the courts, since they estimate that the compensation of 46,942 euros “does not correspond to the severity of the damage.”
The president of the association, Carmen Flores, adds:
“We request the opening of a sanctioning file to the gynecologist who attended the delivery and that she be taken away from her duties for some time and that the necessary measures be taken to prevent cases as serious as this from being repeated.”
