In 2008, a company called Motiva LLC sued Nintendo for infringing with the Wii two of its patents related to a system capable of determining the position and movements of a user, considering that the arrival of said console in the United States would cause damage. to the industry.
Motiva LLC had to demonstrate that it was going to make use of those patents by investing what was necessary for their exploitation (research and development, licenses, etc.), but it did not do so. In fact, the final conclusion is that Motiva had sued Nintendo with the sole intention of getting an economic cut, since it had not planned to launch any product that incorporated the technology described in its patents.
The US Federal Circuit Court of Appeals in Washington DC confirmed yesterday that Nintendo has not infringed any of these patents , so the United States will be able to continue importing the Wii without problems. At Motiva LLC they seem determined to move forward when the case reaches a district court, but I think, given what they have seen, they will have it raw.
